Terms of Service

The terms that govern your use of T2I Eval.

These terms and conditions (the “Terms”) govern your use of T2I Eval (the “Service”), a text-to-image model evaluation tool. By using the Service you agree to these Terms. If you do not agree to them, please do not use the Service.

1. About us

T2I Eval is operated by Mabyduck Ltd, a company registered in England and Wales (company number 15813922), with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom (VAT number 477861046). In these Terms, “we”, “us” and “our” refer to Mabyduck Ltd.

2. Using the Service

You may use the Service only for lawful purposes. You agree that you will not:

  • use the Service in any way that breaches any applicable law or regulation;
  • submit prompts, reference images or other content that is unlawful, infringing, defamatory, obscene, hateful, or that depicts or seeks to generate child sexual abuse material, non-consensual intimate imagery, or other prohibited content;
  • attempt to introduce malware, gain unauthorised access to, interfere with, damage or disrupt the Service, the servers on which it is hosted, or any connected systems or networks;
  • attempt to circumvent rate limits, payment, or any technical measures we use to operate or protect the Service.

We may suspend, restrict or withdraw your access to all or part of the Service at any time if we reasonably believe you have breached these Terms, or to protect the Service or other users.

3. Prompts, images and your submissions

When you use the Service you provide prompts and may upload reference images, and the Service generates images and collects ratings and related evaluation data (together, your “Submissions”).

You confirm that you own or have all necessary rights to your Submissions and that your Submissions, and our use of them as described in these Terms, do not infringe the rights of any third party or breach any law. You must not submit other people’s personal data, or images of identifiable people, without their consent.

You grant us a broad licence to your Submissions and to the images, ratings, results and other content generated through your use of the Service. Specifically, you grant us a perpetual, irrevocable, worldwide, royalty-free, transferable and sublicensable licence to store, reproduce, modify, adapt, publish, analyse, create derivative works from, distribute, sell, and otherwise use and commercially exploit this content for any purpose, including operating and improving the Service, research, training and evaluating models, and creating and selling datasets and other products. This licence continues after you stop using the Service.

This licence covers the content you submit and generate. It does not cover your personal data — such as your email address and payment details — which we handle only as described in our Privacy Policy and do not sell.

We may publish evals and their results publicly through the Service. Do not submit prompts, reference images or other content that you do not want stored, analysed, shared, sold or made public.

4. Generated images

Images are produced by third-party text-to-image models accessed through providers such as OpenRouter and fal.ai. We do not control and are not responsible for the content those models produce, and generated images may be inaccurate, unexpected, or unsuitable for any particular purpose. Generated images and their inputs are retained for a limited period and may be deleted automatically; see our Privacy Policy for details.

5. Payment

Some features of the Service require payment. Prices are shown before you confirm an eval and are charged through our payment processor, Stripe. By submitting payment you authorise us to charge the displayed amount for the eval you request.

Because each eval triggers image generation and human or AI rating that we pay for as soon as the work begins, payments are non-refundable once processing has started, except where required by law.

6. Intellectual property in the Service

We, or our licensors, own all intellectual property rights in the Service itself, including its software, design, text and branding. Nothing in these Terms transfers any of those rights to you. You may not copy, modify or distribute any part of the Service except as expressly permitted by us.

7. Availability and accuracy

The Service is provided on an “as is” and “as available” basis. We do not guarantee that the Service, or any results, scores or rankings it produces, will be uninterrupted, error-free, accurate, or fit for any particular purpose. You rely on the Service and its outputs at your own risk.

8. Third-party services and sites

The Service relies on third parties, including image-generation providers, the Mabyduck rating platform and rater pools, and payment processing. The Service may also contain links to third-party websites. We do not control and are not responsible for those third parties or their content, and their inclusion does not imply our endorsement.

9. Limitation of liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence or for fraud.

Subject to that, we are not liable for any loss or damage that is not reasonably foreseeable, or for any loss of profits, loss of business, business interruption, or loss of data or goodwill arising out of or in connection with your use of the Service. Where the Service is used in the course of a business, we exclude all implied warranties and conditions to the fullest extent permitted by law.

10. Changes to these Terms

We may update these Terms from time to time. The version published on this page is the version that applies, and your continued use of the Service after any change means you accept the updated Terms.

12. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with them. If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
